These terms are an agreement between you and 18050309 Canada Inc. (Yava Concept) ("we", "us"), the maker of the Citizen, Eh? app (the "app", called "Citizen, Eh? Citizenship Prep" in the stores). Please read them. They tell you what you can expect from us and what we ask of you. They are written for consumers: nothing in them takes away a right that the law gives you.
1. About these terms and who we are
- Who the agreement is with. It is between you and us. It is not with Apple or Google (see sections 20 and 21).
- When it starts. It starts when you first use the app or buy a plan, whichever comes first. If you do not agree, please do not use the app.
- Before you buy. The app and the store show you the price, how often it is billed, and whether it renews before you confirm a purchase. You can confirm or cancel at that point. The app shows these terms, with a link and an "I agree" step, the first time it opens.
- Your copy. You can read and save these terms at any time at https://citizeneh.app/terms. If you want a copy by email, write to support@yavaconcept.com. The store sends you a receipt for each purchase.
- Who we are. 18050309 Canada Inc. (Yava Concept), 18 Vankirk Rd, Scarborough, ON M1P 1M7, Canada; +1 416-830-2377; support@yavaconcept.com.
2. What the app is
Citizen, Eh? helps you study for the Canadian citizenship test. It has short lessons, fact cards, quizzes, daily training on the questions you miss, and mock exams in the format of the real test.
- It is a practice tool, not the test. Citizen, Eh? is not the citizenship test, and passing our mock exams does not mean you will pass the real one.
- The practice questions are our own. We write every question, explanation and lesson ourselves, from the official study guide Discover Canada. They are not the real test questions, which the government does not publish. Where facts have changed since the guide was published, we teach today's facts.
- We are independent. Citizen, Eh? is not affiliated with, endorsed by, or connected to the Government of Canada or Immigration, Refugees and Citizenship Canada (IRCC). We cannot help with your citizenship application, book your test, or give immigration advice.
- Check the official source. IRCC sets the test format and rules, and they can change. For your test, see canada.ca. We welcome corrections at support@yavaconcept.com.
3. Who can use it
You must be at least 14 to use the Citizen, Eh? app. The app is made for adults preparing for the citizenship test and is not aimed at children.
If you are under the age of majority where you live, a parent or guardian must agree to these terms for you and is responsible for any purchase. If you are under the minimum age, please stop using the app.
You promise that you can legally enter into this agreement.
4. No account
There are no accounts and no sign-in. Your progress and settings are kept only on your phone. We do not receive them, so we cannot bring them back if they are lost.
- To erase them, use Settings, then Erase everything on this phone, or delete the app. Our Privacy Policy explains what we keep and for how long.
- Your plan belongs to the Apple or Google account you bought it with, not to the phone (see section 7).
- Deleting the app does not cancel a subscription (see section 7).
5. What is free and what is paid
Free: stops 1 and 2 (Rights and Responsibilities, Who We Are) and one free mock exam.
Paid: every plan unlocks all ten stops (with their lessons, quizzes and training) and unlimited mock exams. All plans unlock exactly the same content.
| Plan | Price | Renews? |
|---|---|---|
| Weekly | CA$5.99 a week | Yes, automatically every week, until you cancel. |
| Monthly | CA$15.99 a month | Yes, automatically every month, until you cancel. |
| One-time | CA$25.99 | No. You pay once (a lifetime unlock). |
What you keep getting while you have a plan:
- daily spaced-repetition training that brings back the questions you miss, on the days you need them;
- a new mock exam every time: a fresh mix of 20 questions, with the ones you have not seen first;
- content we keep up to date with current facts, at no extra cost;
- reminders to keep your study on track.
There are no free trials. The free stops and the free mock exam are there so you can try the app before you pay.
The one-time plan ("lifetime unlock") unlocks the paid content for as long as we offer the Citizen, Eh? app. It does not mean for your whole life. Section 15 says what happens if we stop offering the app. When the app says the one-time plan is "yours for good", this is what it means.
6. Prices, taxes and price changes
- Prices are in Canadian dollars. The App Store or Google Play shows the price for your country, and any taxes, before you confirm a purchase. The price you confirm is the price you pay. We add no other fees.
- Taxes. The store adds the sales taxes that apply where you live, such as GST, HST, PST or QST, and shows them before you pay.
- A price change never affects a payment already made. The one-time plan is never charged again.
- If we raise the price of a weekly or monthly plan, we tell you before the new price applies to you, and the new price applies only from your next renewal after that notice. Where Apple, Google or the law requires your agreement, we ask for it first. If you do not agree, cancel in the store before the renewal and you will not be charged the new price. Section 23 says how we give notice.
7. Payments, renewals and cancelling
You buy plans from Apple (App Store) or Google (Google Play), not from us. Their terms also apply to your purchase.
- Payment is charged to your Apple ID or Google Play account when you confirm the purchase.
- Renewal. Weekly and monthly plans renew automatically at the same price, for the same period, unless you cancel. On the App Store, turn off renewal at least 24 hours before the end of the current period, or you will be charged for the next one; Apple charges the renewal within the 24 hours before the period ends. On Google Play, you can cancel any time before the renewal date.
- Cancelling. Cancel in your App Store or Google Play subscription settings. In the app: **Settings, then Manage or cancel** (shown while a plan is renewing). Cancelling takes effect at the end of the period you already paid for, and you keep access until then. We do not charge a fee to cancel.
- Deleting the app does not cancel a subscription. Only cancelling it in the store does.
- Switching plans. Buying the one-time plan does not cancel a weekly or monthly plan. Cancel the subscription in the store as well, or it will keep renewing.
- No account needed to buy. Your plan belongs to the Apple or Google account you bought it with. On another phone, or after erasing the app's data, tap Restore purchases (in Settings) while signed in to that Apple or Google account, and the plan comes back.
- If a payment fails, the store may try again or end the subscription. The paid content locks until the payment goes through.
8. Refunds and your rights to cancel
Apple and Google handle refunds, under their own rules:
- App Store: ask Apple at reportaproblem.apple.com. We cannot refund App Store purchases ourselves.
- Google Play: you can ask Google Play for a refund within 48 hours of buying. After that, write to us at support@yavaconcept.com and we will look at your request. We refund when the paid content did not work as described, or when you were charged by mistake.
- Charged by mistake, or not working. If you were charged by mistake, or you paid and the paid content does not unlock, write to support@yavaconcept.com. We will help you fix it, or ask the store to refund you.
If a purchase is refunded, the paid content locks again. Your progress is kept.
Your rights under the law. Consumer protection laws give you rights that these terms cannot take away. For example, in Quebec and in Ontario, when you agree to a contract online you can cancel it within a short time if we did not give you the information the law requires before you bought, or a copy of the contract. If you want to use a right like this, write to support@yavaconcept.com and tell the store as well. Nothing in these terms limits a refund right you have under the consumer protection law where you live.
9. Using the app fairly
Please do not:
- copy, scrape, publish or sell our questions, lessons, art, sounds or recordings;
- try to unlock paid content without paying, or get around the free plan's limits;
- reverse engineer the app, except where the law allows it;
- overload or attack our servers or our website;
- pretend to be someone else;
- use the app to break the law.
Studying for yourself, and sharing what you learn in your own words, is welcome. Section 14 says what we may do if these rules are broken.
10. Study content and your results
We work hard to make the content correct, fair and current. Even so, it may contain mistakes, and the official test may change. Please check the official source for anything that matters to you.
- We cannot promise that you will pass. Your score in Citizen, Eh? is a guide to how well you know the material. It does not predict your result on the real test. Passing the test also depends on things we do not control.
- This is not legal or immigration advice. The app teaches the study material. It does not tell you whether you qualify for citizenship, when to apply or how. For that, use the official IRCC information at canada.ca or ask a lawyer or a regulated immigration consultant.
- Tell us about errors. If you find a mistake, write to support@yavaconcept.com. We will look at it and fix it if it is wrong.
11. Who owns what, and your licence
We (or the people who license to us) own the app and its questions, lessons, art, animal sounds and read-aloud recordings, and the name and look of Citizen, Eh?. We give you a personal, non-transferable, non-exclusive licence to use the app for your own study, under these terms. We keep every right we do not give you here.
- From the App Store: you may use the app on Apple-branded devices that you own or control, as the Usage Rules in Apple's Media Services Terms and Conditions allow. Family Sharing is not turned on for Citizen, Eh? purchases.
- From Google Play: you may use the app on devices you own or control, as Google Play's terms allow.
Discover Canada is published by the Government of Canada. We do not claim it as ours, and the app does not reproduce its text.
If you think something in the app infringes your rights, write to support@yavaconcept.com and tell us what and why. We will look at it promptly.
12. Your feedback
The app does not let you post content for other people to see. If you send us a message, a correction or an idea, you keep your rights in it, and you let us use it to improve the app, without payment and without any duty on us to use it. We use your personal information as the Privacy Policy says, and for no other reason.
13. Availability, updates and support
- Availability. We aim to keep the app and its purchase features working, but we cannot promise they will never be down. We may pause them for maintenance or fixes. Features that need the internet, such as buying and restoring purchases, do not work without a connection.
- Updates. We may update the app to fix errors, keep facts current, and improve it. Some updates may be needed to keep using the app on newer phones. We will not remove paid content that you have paid for except as sections 15 and 23 allow.
- Support. Write to support@yavaconcept.com or call +1 416-830-2377. We aim to reply within 3 business days.
14. Suspending or ending your access
You can stop using the app at any time. To erase your progress, see section 4. To stop payments, see section 7.
There are no accounts to suspend or close. If someone seriously or repeatedly breaks these terms, misuses the app in a way that harms others or our systems, or if the law requires it, we may block that use of our server and website, or stop answering that person's messages. If we are in touch with you (for example, because you wrote to us), we will first tell you why and give you 7 days to answer. We may act at once only when we must, for example to stop an attack on our servers or to follow a legal order. If we acted without hearing from you, you can write to support@yavaconcept.com to explain, and a person will look at it.
If we end your access for a reason that is not your fault, we will refund the unused part of the period you have paid for. We refund it through the store where we can, or pay it to you ourselves. If your access ends because you broke these terms, you are not owed a refund of what you used, but you keep your legal rights.
What is meant to continue after the end of the agreement does so (see section 27).
15. If we stop offering the app
We may one day stop offering the Citizen, Eh? app, or a part of it. If we do:
- we will tell you in the app and on our website at least 90 days before it ends;
- we will stop renewing subscriptions, and will not charge you for a period after the app ends;
- for each weekly or monthly plan, we will refund the unused part of any period you paid for that falls after the app ends;
- for the one-time plan: if you bought it in the 12 months before the end date, we will refund its price;
- we will keep the app working for you until the end date we told you, and you can ask us for a copy of the information we hold about you before then, as the Privacy Policy says.
16. Our promises and what we cannot promise
We promise to:
- provide the app with reasonable care and skill;
- make the app work substantially as we describe it in the app and in the store listing (what we say about the app in advertising and in the stores binds us, as the law says);
- honour the price and plan you confirmed;
- protect your personal information as our Privacy Policy says.
To the extent the law allows, we do not promise that the app is free of every error, that it is always available, or that it will meet your own particular goals. The app is not a guarantee of any result on the test.
None of this takes away any warranty, condition or right that the law gives you as a consumer where you live (in Quebec, for example, under the Consumer Protection Act). Those stay in full force.
17. Limits on our liability
What these terms never limit. Nothing in these terms limits or excludes:
- our liability for death or physical harm;
- our liability for fraud, intentional wrong, or gross fault;
- our liability for our own acts, or the acts of our representatives, where the law does not allow us to exclude it (for example, under Quebec's Consumer Protection Act);
- any right you have under consumer protection law that cannot be waived.
What we are not responsible for. Apart from that, and to the extent the law allows:
- We are not responsible for your result on the citizenship test, or for any decision about your citizenship application. These depend on you and on IRCC, not on us.
- We are not responsible for losses we could not have reasonably foreseen when you accepted these terms, or for indirect losses such as lost time, lost opportunities or lost income.
- We are not responsible for problems caused by something outside our reasonable control, such as your phone, your internet service, or a failure at Apple, Google or another company (see sections 19 and 20).
- Our total responsibility to you for all claims about the app is limited to the greater of the amount you paid for Citizen, Eh? in the 12 months before the claim and CA$100. This limit does not apply where the law does not allow it, in particular for Quebec consumers.
If you live in a place where the law does not allow some of these limits, they apply only as far as the law allows.
18. If you misuse the app
If you break these terms on purpose (for example, you copy and sell our content, or attack our servers) and we suffer a loss because of it, you are responsible for that loss as the law provides. We do not set a fixed sum or penalty, and we do not ask you to pay our legal costs beyond what a court decides.
This section does not apply to a loss caused by someone else, by a mistake made in good faith, or by our own failure.
19. Events beyond our control
Neither of us is in breach of these terms for a delay or failure caused by an event beyond our reasonable control that we could not reasonably have avoided, such as a natural disaster, a power or internet outage, a war, a strike, a government order, or a failure of the App Store, Google Play or our hosting providers.
The party affected must tell the other as soon as it can and do what it reasonably can to carry on. This section does not excuse a duty to refund what you paid for something you did not receive, and it does not take away your rights under consumer law. If such an event stops you from using a plan you paid for, for more than 30 days in a row, you may ask us for a refund of the unused part.
20. Third-party services and terms
When you use the Citizen, Eh? app, other companies' terms also apply to you, and you must follow them:
- Apple's Media Services Terms and Conditions (App Store purchases);
- the Google Play Terms of Service (Google Play purchases);
- your mobile carrier's or internet provider's terms (for example, data charges when you download the app or buy a plan).
If you got the app from Google Play, these terms are between you and us, not Google. We, not Google, are responsible for the app, its content, support and any claim about it.
Companies that help us run the app (for example, to host our server and website and to check purchases) are listed in the Privacy Policy. We choose them with care. Links to other websites, such as canada.ca, are for your convenience; we do not control those sites.
21. If you got the app from the App Store
These terms are between you and us, not Apple. Apple's minimum terms for apps apply:
- Acknowledgement. These terms are between you and us only. We, not Apple, are responsible for the app and its content.
- Scope of licence. Your licence is as set out in section 11.
- Maintenance and support. We alone provide maintenance and support for the app, as described in these terms (contact us at support@yavaconcept.com or +1 416-830-2377). Apple has no duty to provide any maintenance or support.
- Warranty. If the app does not do what we say it does, you can tell Apple, and Apple may refund the purchase price to you. Apart from that, and to the extent the law allows, Apple has no other warranty duty for the app. Any other claim, loss or cost about a failure to meet a warranty is ours to answer, not Apple's, as these terms and the law provide.
- Product claims. We, not Apple, are responsible for any claim by you or anyone else about the app, including product liability claims, claims that the app does not meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws. Nothing in these terms limits our liability beyond what the law allows.
- Intellectual property. If anyone claims that the app or your use of it infringes their intellectual property, we, not Apple, will investigate, defend, settle and discharge that claim.
- Legal compliance. You confirm that you are not in a country subject to a Canadian or United States government embargo, or designated by the United States government as a "terrorist supporting" country, and that you are not on any Canadian or United States list of prohibited or restricted parties.
- Developer name and contact. 18050309 Canada Inc. (Yava Concept), 18 Vankirk Rd, Scarborough, ON M1P 1M7, Canada; +1 416-830-2377; support@yavaconcept.com. Send questions, complaints and claims about the app there.
- Third-party terms. You must follow any third-party terms that apply when you use the app (section 20).
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple may enforce them against you.
22. Privacy
Our Privacy Policy explains what personal information we collect, why, who helps us handle it, how long we keep it, and your rights, including under the Canadian *Personal Information Protection and Electronic Documents Act* and, if you live in Quebec, Quebec's private sector privacy law. It is a separate document, and you should read it too.
In short: there are no accounts, and your progress stays on your phone; we do not sell your information; there are no ads and no tracking across other apps; and we send you no emails, except replies to your messages. You can ask to see, correct or delete your information at support@yavaconcept.com, or erase what the app keeps on your phone as section 4 says.
23. Changes to these terms
We may change these terms, for example to describe a new feature, to follow a new law, or to fix an error. Here is how:
- Notice. We will tell you about a change at least 30 days before it takes effect. We will tell you in the app and on our website. The notice will show the new or changed clause (and the old one), the date it takes effect, and your rights below.
- What we may change. The description of the free and paid content and features, the rules in section 9, how we give support, and the legal wording of these terms. We will not use this to change a price you have already paid, or to take away a plan you have paid for.
- Your right to say no. If a change makes your duties bigger or ours smaller (a price rise, for example), you can refuse it and cancel without cost or penalty. Tell us, or cancel in the store, within 30 days after it takes effect. A subscription must be cancelled in the store, and we will refund any part of a period you paid for that falls after you cancel.
- If you say nothing, and keep using the app after the date, the new terms apply to you.
- Faster changes. A change can take effect at once only if the law requires it, or if it is clearly in your favour (for example, more free content).
24. The law that applies
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there, except as follows.
- If you live in Quebec, these terms are governed by the laws of Quebec and the federal laws of Canada that apply there, and Quebec's Consumer Protection Act applies in full.
- If you live in another province or territory, the consumer protection laws of your province or territory also apply to you, and these terms do not take away the rights they give you.
You may start a court case about these terms in the courts of the place where you live, as the law allows. If we start one against you, we will do so in the courts of the place where you live.
25. Solving problems
If something goes wrong, write to support@yavaconcept.com first. Tell us what happened and what you would like us to do. We will answer within 30 days, and often faster. This is a first step only. You do not have to use it, and it does not change any time limit the law gives you to act.
- We do not require arbitration. You keep the right to go to court.
- We do not take away your right to bring a class action or to be part of one.
- After a dispute starts, you and we may agree together to try mediation or arbitration. You never have to.
- You may also contact a consumer authority, such as the Office de la protection du consommateur (Quebec), the consumer protection office of your province or territory, or the Competition Bureau Canada.
26. Transferring the agreement
You may not transfer this agreement or your plan to someone else, other than through the stores' own tools.
We may transfer this agreement to another person or business that takes over the app, if they take on these terms and protect your personal information as the Privacy Policy says. We will tell you. If you do not want to continue, you can stop using the app and cancel in the store without cost, and we will refund the unused part of any period you paid for.
27. The rest of the agreement
- If part is not valid. If a court finds that a part of these terms cannot be enforced, the rest stays in effect, and that part is read as narrowly as needed so that it can be enforced.
- The whole agreement. These terms, together with the Privacy Policy and the store rules that apply to your purchase, are the whole agreement between you and us about the app. They do not cancel what we say about the app in the app or in the store listing, which binds us as the law says, and they do not take away your rights under law.
- No waiver. If we do not enforce a right right away, we do not lose it. Our waiver of one breach is not a waiver of another. You do not give up a right you have under consumer law by not using it.
- What continues. After the agreement ends, the sections on ownership (11), liability (17), misuse (18), the law that applies (24), solving problems (25) and this section 27, and any refund or payment already due, continue.
- Reading the terms. Headings are for ease of reading. Where the law says a doubt is settled in the consumer's favour, we follow it.
28. Language
These terms are available in English and in French. Both versions are published, and both have the same value. You may choose the one you prefer, and you may ask us for the other at any time.
If you live in Quebec, we offer you the French version first. If you choose to be bound by the English version after having received the French version, that is your express wish, and the version you accepted applies to you. If the two versions ever seem to differ, we read them in the way that is more favourable to you.
The French version is at citizeneh.app/fr/terms. Les présentes conditions sont offertes en français et en anglais.
